The purpose of this Workshop/Hearing is to solicit comments from all interested persons regarding LCB File Number(s)

• R007-09, which relates to motor vehicles, defining certain requirements for dealers, rebuilders, manufacturers, distributors and brokers to keep and maintain the books and records of their business transactions and; defining certain requirements for dealers who engage in the consignment of vehicles for sale that are owned by another person. (Chapter 482 of NAC)
• R008-09, which is in relation to body shops and the certification of specific body shops as “Class “A” facilities; setting forth criteria for that certification and the penalties for failure to maintain that criteria. (Chapter 487 of NAC)
• R009-09, which is in relation to motor vehicles; providing certain requirements for determining a person’s continued suitability to maintain a Nevada Driver’s License or identification card previously issued under less stringent criteria and requirements than currently required for establishing proof satisfactory to the Department of a person’s true identity. (Chapter 483 of NAC)
• R014-09 – which relates to inspections of motor vehicles owned by this State and any of its political subdivisions. (NAC 445B.443, 461 & 595)
• Proposed amendment relating to motor vehicles; providing certain requirements for outdoor signs posted at motor vehicle body shops licensed by the Department. (NAC 487.150)
• Proposed amendment relating to motor vehicles; providing certain requirements for outdoor signs posted at authorized emission stations licensed by the Department. (NAC 445B.469)
• R022-07, which revises provisions for licensing authorized emission stations (NAC 445B.460, 505, 5052, 5065, 5075 & 5805)
• R105-07, which revises the provisions governing the operation of certain test stations; revising the provisions applicable to prescribed emission test procedure regarding light duty diesel vehicles; and providing other matters properly relating thereto. (NAC 445B.589 & New Section 2)
• Proposed amendment relating to motor vehicles powered by diesel engines; prescribed test procedure (NAC 445B.589)
• Proposed amendment relating to motor vehicles not subject to certain provisions of Chapter 445B; (NAC 445B.592)

If no person who is directly affected by the proposed action appears to request time to make an oral presentation, the Department of Motor Vehicles may proceed immediately to act upon any written submissions.

There is no economic effect of the regulation on the public, nor is there a cost to the agency for enforcement of the proposed regulations.

The proposed amendment of regulations pertaining to Chapter 445 of the Nevada Administrative Code does not overlap or duplicate that of any other state or local governmental agency. These regulations are not required pursuant to federal law, nor does the federal government regulate similar activities.

Persons wishing to comment upon the proposed action of the Department of Motor Vehicles may appear at the scheduled public hearing or may address their comments, data, views, or arguments, in written form to:

Written submission must be received by Department of Motor Vehicles on or before August 12, 2009.

A copy of this notice and the regulations to be adopted and/or amended will be on file at the State Library, 100 Stewart Street, Carson City, Nevada, for inspection by members of the public during business hours. Additional copies of this notice and regulations to be adopted and/or amended will be available at each of the Department of Motor Vehicles listed, and at the main public libraries listed, for inspection and coping by members of the public during business hours. Copies of this notice and the proposed regulation will also be mailed to members of the public upon request. A reasonable fee may be charged for copies if it is deemed necessary.

Upon adoption of any regulation, the agency, if requested to do so by an interested person, either before adoption or within 30 days thereafter will issue a concise statement of the principal reasons for and against its adoption and incorporate therein its reason for overruling the consideration urged against its adoption.
